AdvertisingCharts.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, AdvertisingCharts.com will respond expeditiously to claims of copyright infringement committed using our website that are reported to our Designated Copyright Agent, identified below.
If you are a copyright owner or an authorized agent thereof and believe that any content on AdvertisingCharts.com infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on AdvertisingCharts.com are covered by a single notification, a representative list of such works;
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit AdvertisingCharts.com to locate the material;
4. Information reasonably sufficient to permit AdvertisingCharts.com to contact you, such as an address, telephone number, and, if available, an electronic mail address;
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.
Please be aware that if you knowingly materially misrepresent that material or activity on AdvertisingCharts.com is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.
Counter-Notification Procedures
If you believe that material you posted on AdvertisingCharts.com was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a “Counter-Notice”) by submitting written notification to our Designated Copyright Agent. The Counter-Notice must include substantially the following:
1. Your physical or electronic signature;
2. An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;
3. A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which AdvertisingCharts.com may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
Upon receipt of a Counter-Notice, AdvertisingCharts.com will promptly provide the complaining party with a copy of the Counter-Notice and inform them that the removed material may be replaced or access to it restored in 10 business days. AdvertisingCharts.com will replace the removed material and cease disabling access to it within 10 to 14 business days following receipt of the Counter-Notice unless our Designated Copyright Agent first receives notice from the complaining party that such complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on AdvertisingCharts.com.
Repeat Infringers
It is AdvertisingCharts.com’s policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who are repeat infringers.
